What is Mediation
Mediation is a voluntary process where a neutral third party, the Mediator, assists disputing parties in reaching a mutually agreeable resolution. The Mediator promotes communication and collaboration, aiming to resolve conflicts outside of formal legal channels. The MyMediation™ practitioner facilitates discussions, considers alternatives and assists the involved parties reach a win/win outcome.
In 2021, there were virtually no civil cases running to trial without parties first participating in mediation, and the postpandemic backlog of cases will only serve to increase this trend. This, and those in the commercial world demanding efficient dispute resolution processes and outcomes to keep pace with an ever-quickening economy, will see more disputes referred to and resolved in mediation – before and after legal action has commenced. Put simply, mediation is no longer the alternative, but the norm. Take the first step today. Apply to study online and become a MyMediation™ Accredited Mediator. |
The MyMediation™ Model for Successful Mediations
The MyMediation™ model is designed for parties in a dispute to communicate directly with the Mediator in their words, thereby sharing their perspectives without the Mediator reviewing court documents, letters from legal counsel, or legal counsel involvement in the Mediation session.
Instead, the Mediator uses their wisdom, knowledge, empathy and soft skills, as well as carefully chosen words, to facilitate a “caring conversation.” This approach helps the disputants express their wants, needs, and expectations, working together towards a win/win mediated outcome. |
